Attestation

Attestation literally translates to "An act of ensuring and attending the execution of a document or certificate and bearing witness to its authenticity by signing one's own name to it in order to affirm that it is genuine."A custodian of records demonstrates that a copy of an original document is a true copy of his/her signature on the certificate. In India, the official Attestation authorities for General documents are a Principal of a Secondary or Higher Secondary School or College or University, Notary Public, any Gazetted Officer or Section Officer of Government of India, etc.It must be noted that the said authorities are only entitled to attest true copy of documents. In case wherein an individual is planning to go abroad, the individual's original documents need to be attested. And to attest the same, the Ministry of External Affairs (MEA), Government of India (GOI), has given the power to various General Administrative Departments, State Home Departments, Higher Education Department or Sub-Divisional Magistrate, New Delhi, etc.




Alternative Apostille Certification Procedure Followed in India

This alternative process is widely followed in India. This process involves various steps. First, attestation is required from the Sub-Divisional Magistrate (SDM). Second, the degree certificate needs to be Apostilled by the Ministry of Foreign Affairs (MOFA) or the Ministry of External Affairs (MEA). This is a genuine and acceptable procedure used by a large number of Hague Conventional Countries (HCC) worldwide.However, some countries are very particular about the Degree Certificate Apostille Procedure and require state level Authentication/Attestation (HRD, GAD, Home Department, etc.) on the Degree Certificate before it is Apostilled from the Ministry of Foreign Affairs (MOFA) or the Ministry of External Affairs (MEA).







Apostille

Apostille is the facilitated certification of public documents (that may be notarized), for their use globally and internationally in all nations that are a part of the Hague Convention's Apostille Section. The Signatory countries under the Apostille Section of the Hague Convention have agreed to recognize public documents officiated by the "Apostille".This certification is to ensure that apostilled public documents are valid within the country where the document had been originally notarized or issued. The Apostilles main function is to verify the authenticity of the signature on the given document (i.e., Notary Public, County Clerk, State Registrar, Judge or Vital Records Officer).The Apostille is also instrumental in certifying that the capacity in which the signatory person of the document has acted and the identity of any seal or stamp affixed to the said document. The Apostille is a one-page long document which is embossed with the Great Seal of the State and includes the facsimile signature of the individual who is issuing the said certificate.There are at present more than 75 member states that are a part of the Hague convention, and many other countries will go on to join the Apostille Section, Hague Convention, in the future so that they are able to recognize the Apostille for the easy international legalization of documents.The Apostille is only applied to public documents and is signed by an official who is connected with a tribunal or court of the State (this includes all documents that are issued by a public prosecutor, an administrative, ecclesiastical, or constitutional tribunal or court, a process-server or a clerk).Notarial acts, administrative documents, and official certificates that are placed on documents which are signed by people in their private capacity, the likes of official certificates which record the registration of a document or the soul fact that it had been in existence on a certain date and notarial and official authentication of signatures.Every kind of document, which includes: Adoption Certificate, Birth Certificate, Marriage Certificate, Death Certificate, Divorce Decrees, School Diploma, Transcripts, Power of Attorney, Affidavits, Corporate Documents, Identity documents and/or Passports, Wills and Deeds, Bills of Sale, Agreements, Proof of Ownership, Private Documents etc.In India Degree Certificate Apostille Attestation is carried out by the Competent Authorities that have been designated by the Government of India, which is by definition party to the Hague Convention.The Hague Conference on the issue of Private International Law maintains a list of such authorities. For example, the Ministry of Foreign Affairs (MOFA) and the Ministry of External Affairs (MEA) are the chosen competent authority in India in charge of affixing Apostille Attestation.The Apostille Agreement of the Hague Conference specifies the modalities that need to be taken care of when a document is issued in any of the signatory countries to be certified for legal requirements in all the other signatory countries. This type of certification is known as an Apostille. An Apostille is the international equivalent of a Notarization (in domestic law).






HRD Authentication

HRD Authentication is a requirement for all those documents that need to be attested by the Ministry of External Affairs (MEA) followed by attestation from the Consulate or Embassy of the country of destination. MHRD is available to customers in all states as a responsibility of the state government.We provide document attestation services of HRD. Once the document has been authenticated from the HRD, it is processed by the Ministry of External Affairs (MEA).

Such attribute comparison is liable to be vulnerable to forgery.This relies on the fact that the creation of a forgery that is indistinguishable from its genuine counterpart artifact requires expert knowledge and skill, that mistakes can be easily made, or that the actual amount of effort that is required to carry out such a project is considerably greater than any amount of money that may be gained by selling the forgery to generate profit.Civil and criminal penalties are levied for forgery, fraud, and counterfeiting and can considerably reduce the incentive for falsification and forgery, depending upon the risk factor involved of getting caught.The third authentication technique relies on documentation and other external affirmations. For instance, normally the rules of evidence in criminal courts often require the establishment of the chain of custody of the evidence that has been presented at the hearing.This goal can be accomplished through a log of written evidence, or by the testimony of the forensics staff and police detectives that had handled the given evidence. Legalization

The word legalization literally translates to "A process that involves certification of a document so that it is recognized officially by the legal system of a foreign nation."
